			<content:encoded><![CDATA[<p>The UK largest lottery is known as the National Lottery, which was set up under government licence in 1993. A statute of 1698 provided that in England lotteries were by default illegal unless specifically authorised by statute.</p>
<p>An 1934 Act legalised small lotteries, which was further liberalised in 1956 and 1976. There could be no big national lottery until the Government established one, however.</p>
<p>Several lottery games are run under this brand, including Lotto and Thunderball. As with other lotteries gamblers choose a set of numbers, say 6 from 50, with six numbers then being drawn at random. Lotteries gamblers win cash prizes depending on how many numbers they match. The national lottery launched a Pan European &#8220;super-lottery&#8221;, called EuroMillions in 2004. Currently 9 countries contribute.</p>
<p><span id="more-35"></span>In the United Kingdom the national lottery has so far raised several billions of pounds for Good Causes, a programme which distributes money via grants. 28% of lottery revenue goes towards the fund, along with all unclaimed prizes. Additionally, 12% goes to the state. The prize fund is 45% of revenue, with the remaining 15% going towards running costs and profits for the lottery organisers and ticket sellers.</p>

<p>In this Act “sports betting” means making or accepting a bet on:</p>
<ul>
<li>The outcome of a race, competition or other event or process</li>
<li>The likelihood of anything occurring or not occurring</li>
<li>Whether anything is or is not true</li>
</ul>
<p>A transaction that relates to the outcome of a race, competition or other event or process may be a bet within the meaning of subsection despite the facts that:</p>
<ul>
<li>The thing has already occurred or failed to occur</li>
<li>One party to the transaction knows that the thing has already occurred or failed to occur</li>
</ul>
<p><strong>Spread Bets:</strong></p>
<ul>
<li>For the purposes of section “bet” does not include a bet the making or accepting of which is a regulated activity within the meaning of section 22 of the Financial Services and Markets Act of Betting 2000</li>
<li>An order under section 22 of that Act which has the effect that a class of bet becomes or ceases to be a regulated activity may, in particular, include transitional provision relating to the application of this Act to that class of bet.</li>
<li>This section is subject to section.</li>
</ul>
<p><strong>Sports Betting: Prize Competitions</strong></p>
<p>For the purposes of section 9 a person makes a bet (despite the fact that he does not deposit a stake in the normal way of betting) if:</p>
<ul>
<li>He participates in an arrangement in the course of which participants are required to guess any of the matters specified in section 9</li>
<li>He is required to pay to participate</li>
<li>If his guess is accurate, or more accurate than other guesses</li>
<li>Win a prize</li>
<li>Enter a class among whom one or more prizes are to be allocated (whether or not wholly by chance).</li>
</ul>
<p><span id="more-31"></span>In subsection 1 a reference to guessing includes a reference to predicting using skill or judgment.<br />
Schedule one makes further provision about when a person is to be or not to be treated for the purposes of one subsection as being required to pay to participate in an arrangement.<br />
In subsection 1 “prize” includes any money, articles or services:</p>
<ul>
<li>Whether or not described as a prize</li>
<li>Whether or not consisting wholly or partly of money paid, or articles or services provided, by the members of the class among whom the prizes are allocated</li>
</ul>
<p><strong>Pool Betting:</strong></p>
<p>For the purposes of this Act sports betting is pool betting if made on terms that all or part of winnings:</p>
<ul>
<li>Shall be determined by reference to the aggregate of stakes paid or agreed to be paid by the persons sports betting</li>
<li>Shall be divided among the winners</li>
<li>Shall or may be something other than money.</li>
</ul>
<p>For the purposes of this Act pool betting is horse race pool betting if it relates to horse-racing in the United Kingdom.</p>
<p><strong>Betting Intermediary:</strong></p>
<ul>
<li>In this Act “sports betting intermediary” means a person who provides a service designed to facilitate the making or acceptance of bets between others.</li>
<li>For the purposes of this Act acting as a betting intermediary is providing facilities for sports betting.</li>
</ul>

<p>There is a large market in the United Kingdom for gambling and betting on competitive sports at bookmakers, particularly for horse racing, greyhound racing and association football. The latter also has an associated form of gambling known as the football pools, in which players win by correctly predicting the outcome of each weeks matches.</p>
<p>Sports betting is defined by the Gambling Act 2005 as the making or accepting of a bet on the outcome of a horse race, competition or other event or process. The likelihood of anything occurring or not occurring, or whether anything is or is not true.</p>
<p><span id="more-27"></span>Pool betting can be conducted  remotely  or no-remotely. Remote pool betting is conducted, for example, via an internet betting site run by one of the football pools operators. Non-remote pool betting in the UK is conducted in person (for example, the Tote, which accepts pool bets on tracks and in high street sports betting shops).</p>

The Betting and Gaming Act 1960 allowed commercial bingo halls to be set up, provided they were established as members-only clubs and had to get their take from membership fees and charges rather than as a percentage of the entry fees.</p>
<p>Casinos had a similar history, with requirement for licensing from the Gaming Board of Great Britain and for casinos to be members-only. The number of gaming machines in casinos was limited at 10. In part due to the difficulty of enforcing this, the Gaming Act 1968 liberalised the law, by allowing true commercial casinos.</p>
<p>Gambling Act of 2005 paved the way for the larger resort-style casinos to be built, albeit in a controlled manner with one constructed every few years before the law in full. In many cities bid to host one of these so-called &#8220;super-casino&#8221;, which will be similar to those found in Las Vegas. January 30, 2007 Manchester, was declared the winner of the quest to be the place of the first &#8220;super casino&#8221;. The House of Lords called on March 29, 2007 Government to review plans for the massive super-casino in Manchester. Instead, it supports plans for fewer than 16 casinos, including Solihull and Wolverhampton. This Act of Parliament significantly updated the UK&#8217;s gambling laws, including the introduction of a new structure of protections for children and vulnerable adults, as well as bringing the burgeoning Internet gaming sector within British regulation for the first time.</p>
<h3>UK Gambling Commission:</h3>
<p>The Gambling Commission was set up under the Gambling Act 2005 to regulate commercial gambling in Great Britain.<br />
We are an independent non-departmental public body (NDPB) sponsored by the Department for Culture, Media and Sport (DCMS).<br />
The Gambling Commission (the Commission) has published updated advice for organisers of prize competitions and free draws. The revised advice benefits from the experience gained in the two years since the Gambling Act 2005 (the Act) came into effect in September 2007. It reflects changes to the Commission’s general understanding of how the Act applies.</p>
<p>Commenting on the proposals, the Commission’s Deputy Chief-Executive, Tom Kavanagh said: “Our role is to protect good causes by policing the boundary between prize competitions, free draws and licensed lotteries. We do not approve prize competitions or free draws but operators who seeking to stay within the law should read this publication and take independent legal advice before proceeding.”</p>
<p><span id="more-19"></span>The Commission regulates gambling in the public interest. It does so by keeping crime out of gambling, by ensuring that gambling is conducted fairly and openly, and by protecting children and vulnerable people from being harmed or exploited by gambling. The Commission also provides independent advice to government on gambling in Britain.</p>
<p>The Commission is responsible for licensing and regulating all gambling in Great Britain other than the National Lottery and spread betting, which are the responsibility of the National Lottery Commission and the Financial Services Authority (FSA) respectively. The publication of the updated advice follows a public consultation in the summer.</p>
<p>The plans, which will be subject to a consultation period, would mean that online operators currently licensed outside Britain will have to apply for a licence from the Gambling Commission if they want to advertise or provide their gambling services to British consumers.</p>
<p>Under the plans, all online gambling firms active in the British market will have an obligation to share information about suspicious betting patterns with the UK’s sports governing bodies as well as the Gambling Commission. They will also have to comply with British licence requirements including the protection of children and vulnerable people, and will have to demonstrate how they will contribute to the research, education and treatment of problem gambling in Britain.</p>
<p>The Government is considering what the plans mean for operators based in countries outside Europe – specifically in terms of the Government’s approved ‘whitelist’ of countries whose operators are able to advertise in the UK. The Government intends to keep the ‘whitelist’ in some form and it will remain a fundamental part of any future regulatory system.  Proposals for any changes to the system will be included in the consultation.</p>
<p>Today’s plans have been announced following a review of the system of online gambling regulation in Great Britain, focusing on consumer protection and ways to ensure that overseas operators contribute towards regulation, problem gambling treatment and the Horserace Betting Levy. The review has looked in some detail at the way the system currently works, as well as exploring the significant regulatory changes taking place in Europe and beyond. The Government is still investigating ways to secure fair contributions from overseas operators to the Horserace Betting Levy.</p>
